A few hours after the ‘Ninja Dan’ murder case was declared a mistrial, Director of Public Prosecutions Victoria Charles-Clarke has decided to order a retrial.
The DPP has said this not the first time that such a move has been made.
A mistrial judgment was handed down by Justice Francis Cumberbatch at about 9:00p.m. (May 4).
The jury was unable to reach a verdict after one of 12 jurors, maintained a not guilty count.
A unanimous decision either to convict or acquit the defendant is always necessary in capital offences.
St. Rose has been charged along with two other men – Lyden Blasse and Marvin Terry Nelson – in connection with the February 2009 death of Dwayne ‘Chubby’ James.
James was stabbed multiple times at Maynard Hill, Marchand on Saturday, February 14, 2009.
St. Rose and his colleagues have been on remand for close to six years at Bordelais Correctional Facility.
