The babymother of slain Dwayne ‘Chubby’ James has said she has forgiven popular soca artiste Jonathan ‘Ninja Dan’ St. Rose and his two accused, but she is disappointed in the St. Lucian justice system.

After spending seven years and four months on remand, St. Rose, Lynden Blasse and Marvin Nelson were today, Jan. 18 freed after their application to the Court of Appeal, challenging their 20-year sentencing for manslaughter by the High Court last June, was successful. The appeals court granted them time spent behind bars.

The trio were initally jointly charged for murder in the Valentine’s Day 2009 stabbing death of James. The men pleaded guilty to a lesser charge of manslaughter prior to their sentencing last year.

Beverly Evelyn, the mother of James’s two children, said she believes only one of the two men are innocent. Regardless, she said, she has forgiven them “from the day I gave my life to the Lord”.

“It was hard,” she said, “but in the end the Lord will do all his judging. I leave it up to him.”

Evelyn, who now lives in New York, said she gave her life to Jesus Christ last year June/July.

She said her “spirit” tells her only one of the trio is guilty of killing her children’s father.

“To tell you the truth there is only one in my mind that looked innocent. All how I saw him in the courtroom, my spirit kept on telling me he is innocent…”

The killing of James marked the third homicide in St. Lucia in 2009.

12717273_10153803764879333_2270036344305142509_nAccording to an official police press release, James, a resident of Trou Rouge, Marchand, within the city of Castries, was stabbed several times as a result of an “alleged domestic dispute” on Friday, February 14, 2009, about 2 a.m.

Police said James, 30 years old at the time, was “standing near the house of a female friend whom he had earlier visited at Maynard Hill, Castries, when he was attacked by a group of men who beat up on him until he was stabbed in the process”.

He was later taken to the Victoria Hospital, Castries where he was pronounced dead upon arrival.

Police said a post mortem performed on his body on Monday, February 16, 2009 revealed death bhy “aemorrhagic shock, secondary to multiple stab wounds”.

Evelyn said she remembers the night James was killed but was not present during his attack.

“The night in question I was at home sleeping with my then four-year-old daughter and my son still inside of me. I don’t know what happened. I cannot tell.”

However, the death caused her to give birth prematurely.

“Well, at the time I was seven and a half months …. I had my son four days after his father’s murder,” she noted.

The children are grown now but the pain still lingers. The girl is eleven and the boy is seven.

“Well my kids know by now their father will not be coming back home and he is resting with the Lord,” Evelyn told SNO.

“My daughter used to cry herself to sleep. Everytime the news would come up about the case she would cry, but his (James’s) mother and myself would always make her laugh (and) tell her how her dad used to stop traffic when he drinks too much, and how he couldn’t wait Sundays to go get his Mac and cheese from his mom.”

Evelyn said she is surprised that the trio are now free, even though they spent seven-plus years on remand.

“No it’s not enough but there is nothing I can do . Our justice system need to be fixed,” she said.
